Terms of Service

IMPORTANT — PLEASE READ CAREFULLY: TTM is an informational data service only. It is not a law firm, tax advisor, property tax consultant, or licensed appeal service. Nothing on this site or in any report constitutes legal advice, tax advice, or professional advice of any kind. TTM does not file appeals on your behalf. All dollar figures shown are mathematical estimates only and do not predict, promise, or guarantee any tax savings or appeal outcome. You are solely responsible for any decisions you make based on information provided by TTM.

1. Acceptance of Terms

By accessing or using TTM ("Service"), including the website at taxedtoomuch.com and any reports, data, or content provided through the Service (collectively, "Materials"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

2. Description of Service — Informational Data Tool Only

TaxedTooMuch ("TTM," "we," "us," or "our") is an informational data tool that retrieves, organizes, and presents publicly available property assessment data from the Cook County Assessor's Office ("CCAO") open data portal. The Service compares a property's assessed value per square foot against similar properties in the same CCAO assessment neighborhood.

TTM is not, and does not purport to be, any of the following:

  • A law firm or legal service provider
  • A licensed tax advisor, accountant, or tax preparer
  • A property tax consultant or appeal service
  • A government agency or government-affiliated service
  • A representative or agent acting on your behalf before any government body

We do not practice law. We do not provide legal advice. We do not represent property owners before the Cook County Board of Review, the Cook County Assessor's Office, or any other government body. We do not file appeals on your behalf. We do not negotiate with any government agency on your behalf.

3. No Legal Advice — No Professional Relationship

All content, reports, data, comparisons, analyses, estimates, summaries, and any other Materials provided by TTM are for general informational purposes only. Nothing provided by TTM should be construed as legal advice, tax advice, accounting advice, financial advice, or professional advice of any kind.

No professional relationship of any kind is formed by your use of this Service, including but not limited to: no attorney-client relationship, no accountant-client relationship, no advisor-client relationship, and no fiduciary relationship. Your use of TTM does not create any duty of care owed to you by TTM beyond the express terms stated herein.

If you require legal advice regarding your property tax assessment, appeal rights, or any related matter, you should consult a licensed Illinois attorney. If you require tax advice, you should consult a qualified tax professional.

4. All Dollar Figures Are Estimates Only — No Guarantee of Savings

TTM may display dollar figures, including but not limited to: estimated assessment differences, estimated annual and multi-year overpayment amounts, hypothetical reduction scenarios, and other numerical estimates (collectively, "Estimates").

ALL ESTIMATES ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE PREDICTIONS, PROMISES, OR GUARANTEES OF ANY ACTUAL TAX SAVINGS, ASSESSMENT REDUCTIONS, OR APPEAL OUTCOMES.

Estimates represent mathematical calculations based on publicly available data and are subject to the following limitations:

  • They are based on a comparison of assessed values in public data, which may contain errors or may not reflect the most current assessments
  • They assume a hypothetical best-case scenario that may not be achievable
  • They do not account for factors the Board of Review may consider that are not reflected in the data (property condition, improvements, errors in recorded characteristics, etc.)
  • Actual tax bills depend on equalization factors, levy rates, and exemptions that change annually and are outside the scope of this Service
  • There is no guarantee that any appeal will be filed, accepted, heard, or granted

You should not rely on any Estimate as a prediction of actual savings. Whether a property tax appeal succeeds is determined solely by the Cook County Board of Review or other applicable authority, based on their independent review of evidence submitted. TTM has no control over, and makes no representation about, the outcome of any appeal.

Summary aggregate figures shown on the website (such as county-wide over-assessment counts) are derived using the methodology described here.

5. TTM Does Not File Appeals

TTM does not file, submit, or transmit any appeal, petition, complaint, or other document to the Cook County Board of Review, the Cook County Assessor's Office, or any other government body on your behalf.

You are solely responsible for:

  • Deciding whether to file an appeal
  • Preparing and submitting your own appeal documents
  • Complying with all applicable filing deadlines, procedures, and requirements
  • Verifying all information before submission to any government body
  • Any consequences arising from your decision to file or not file an appeal

Any general information about the Board of Review process provided by TTM is for informational convenience only and may not be current, complete, or applicable to your specific situation. Always verify procedures and deadlines directly with the applicable government agency.

6. AI-Generated Content

Certain Materials may be generated in whole or in part by artificial intelligence ("AI"). AI-generated content, including but not limited to data summaries and comparable property analyses, may contain errors, inaccuracies, or omissions.

AI-generated content is provided "as is" for informational purposes only. It is not a legal document. It does not constitute legal advice. It has not been reviewed by an attorney. You must independently verify all information contained in AI-generated content before relying on it or submitting it to any government body. TTM disclaims all liability for errors or omissions in AI-generated content.

7. Data Accuracy — No Warranty

TTM sources data from the Cook County Assessor's Office open data portal (datacatalog.cookcountyil.gov), a public government database. While we make reasonable efforts to present this data accurately, we make no warranties, express or implied, regarding:

  • The accuracy, completeness, timeliness, or currency of any data
  • Whether the source data contains errors, omissions, or outdated information
  • Whether comparable properties identified by our algorithm are appropriate comparables for a formal appeal
  • Whether any assessment figures reflect the most recent reassessment cycle
  • Whether the data is suitable for any particular purpose

All data and Materials are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. TTM disclaims all liability for errors in underlying government data.

8. All Sales Final — No Refunds

All purchases of TTM reports are final and non-refundable. By completing a purchase you acknowledge and agree that:

  • You have reviewed the free comparison results prior to purchase and understand what the paid report contains
  • You are purchasing access to an informational data report, not legal advice, tax consulting, or a guaranteed outcome
  • Digital reports are delivered immediately upon payment and cannot be "returned"
  • No refund will be issued if your appeal is denied, if the data differs from your expectations, if estimated savings are not realized, or for any other reason
  • TTM does not guarantee any particular result from use of the report

If you believe you were charged in error due to a technical failure (e.g., payment processed but report not delivered), contact us at legal@taxedtoomuch.com within 7 days and we will investigate.

9. Assumption of Risk

You acknowledge and agree that:

  • Filing a property tax appeal involves inherent risks and uncertainties
  • The decision to file an appeal, and the consequences of that decision, are entirely your own
  • TTM's Materials are one source of information among many, and should not be the sole basis for any decision
  • You have been advised to consult a licensed attorney or qualified tax professional before making decisions about your property taxes
  • You assume all risk associated with your use of the Service and any actions you take based on the Materials

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPFAX'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, YOUR USE OF THE SERVICE, OR ANY MATERIALS PROVIDED SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO PROPFAX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (NOT TO EXCEED $49.00 PER REPORT PURCHASED).

IN NO EVENT SHALL PROPFAX, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Lost tax savings or unrealized estimated savings
  • Costs of filing an appeal (including attorney fees, consultant fees, or government filing fees)
  • Damages arising from a denied appeal or an appeal that produces less savings than estimated
  • Lost profits, lost revenue, or loss of business opportunity
  • Loss of data or damage to data
  • Damages arising from reliance on any data, estimates, or AI-generated content
  • Damages arising from missed deadlines or procedural errors in an appeal you filed

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if TTM has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless TTM and its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or related to:

  • Your use of the Service or any Materials
  • Any appeal or other action you take based on information from the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any claim by a third party arising from your use of the Service

12. Dispute Resolution — Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and TTM agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any Materials (collectively, "Disputes") shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and not through a lawsuit in court (except for small claims court, where eligible).

CLASS ACTION WAIVER:You and TTM each agree that any Dispute shall be brought in the parties' individual capacities only and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of multiple parties.

The arbitration shall take place in Cook County, Illinois, or at another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

Opt-Out: You may opt out of this arbitration provision by sending written notice to legal@taxedtoomuch.com within 30 days of first using the Service. Your notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration.

13. Public Data

The assessment data displayed by TTM is sourced from public records published by the Cook County Assessor's Office under its open data initiative. This data is publicly available and is presented here as a convenience for informational purposes. TTM does not claim ownership of any government data. TTM is not affiliated with, endorsed by, or connected to the Cook County Assessor's Office, the Cook County Board of Review, or any government agency.

14. Intellectual Property

The TTM website, software, design, algorithms, and original content (excluding government data) are the property of TTM and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service or its Materials, except for personal, non-commercial use in connection with your own property tax research.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. To the extent any Dispute is not subject to arbitration under Section 12, you agree that such Dispute shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TTM regarding your use of the Service and supersede all prior agreements and understandings.

18. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page will reflect the most recent revision. Continued use of TTM after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
